TripOnTrib, S.L. (hereinafter, “TripOnTrib”) is a Spanish company with registered address at Calle Juan Bautista Monegro nº 7, 1º D, Torrejón de Ardoz, 28850, Madrid, and Tax ID B19950666, duly registered in the Madrid Companies Register.

TripOnTrib owns all Intellectual and Industrial Property rights or any other rights over the mobile application “TripOnTrib” (hereinafter, the “Application” or the “App”).

The use of the Application is subject to the following Terms and Conditions of Use (hereinafter, the “Terms and Conditions”).

1. ACCEPTANCE

1.1. By registering and using the Application, the User expressly agrees to be bound by these Terms and Conditions.

1.2. In addition, the User is subject to TripOnTrib’s Privacy Policy and Cookie Policy, available within the Application and on the official website.

2. PURPOSE OF THE APPLICATION

2.1. The purpose of the Application is to connect people with shared travel interests to create, organize, or join group plans and trips; promote participation in thematic communities; and facilitate safe interaction between Users, including reputation and review systems.

2.2. Main features.
The User may, among other things:

• Register and create a profile.
• Create and organize plans/trips for other Users to join.
• Explore and join communities (e.g., by trip type, style, interests), share knowledge and experiences, ask questions, and participate in general chats.
• View and receive information about plans/trips published by other Users and, if desired, join them.
• Provide ratings and reviews about trips and fellow travelers with whom they have participated.
• Interact with other Users through the communication features provided by the App.

2.3. Adults and natural persons.
Use is limited to natural persons over 18 years old acting on their own behalf for personal purposes, ensuring the accuracy of the information provided.

2.4. Verification and usage levels.

• Unverified registration: Users may register and use basic functions (e.g., explore content, join communities, participate in general chats, and save content).
• Advanced features (require verification): to join a plan/trip created by another User or to create and publish their own plan, the User must complete profile verification (upload of identity document photo and a selfie). Until then, advanced features cannot be used. Verification may also be required for other sensitive features determined by TripOnTrib for security and fraud prevention, as indicated in the App.
• Verification is carried out in accordance with the current Privacy Policy.

2.5. Profile rules and visibility after a trip.
To foster trust and accountability, after completing a trip through the App, the User may access the profile of the companion(s) they traveled with to rate the experience, leave a review, and view the shared history within the App. Reviews must be truthful, respectful, and comply with content policies.

3. USE OF THE APPLICATION

3.1. Definitions.

• Use: download and installation of the App, registration, and use of its functionalities.
• Registration: account creation and provision of requested data to access certain features (including verification where applicable). The User must be at least 18 years old; they commit to provide accurate, complete, and up-to-date data, will not use names that do not belong to them, will not impersonate others, and may not transfer their account without TripOnTrib’s authorization.

3.2. Conduct rules.
The User shall not use the App for illegal, prohibited, or harmful purposes, or in any way that damages, overloads, or affects the stability or security of the App.

3.3. Indemnity.

To the fullest extent permitted by law, the User shall indemnify TripOnTrib against third-party claims arising from the breach of these Terms or improper use of the App, covering defense costs (including legal fees) and applicable damages.

3.4. Personal and non-commercial use.
The App is offered for personal and non-commercial use. The User declares they will not derive economic benefit from its use, unless prior written agreement with TripOnTrib exists.

3.5. Measures against breaches.
TripOnTrib may suspend or cancel the account of a User who violates these rules and take any measures deemed necessary to protect the community.

4. INTELLECTUAL AND INDUSTRIAL PROPERTY

4.1. Ownership and definition.
All Intellectual and Industrial Property rights over the App are and will remain the property of TripOnTrib. This includes, among others, copyright (including software), databases, designs, patents, trademarks, trade names, know-how, trade secrets, domain names, and any analogous or equivalent rights worldwide, as well as rights derived from licenses and consents.

4.2. License of use.
TripOnTrib grants the User a limited, non-exclusive, non-transferable, and non-sublicensable license to use the App for personal purposes in accordance with these Terms and the law.

4.3. Restrictions.
It is prohibited to reproduce, distribute, modify, create derivative works, publicly communicate, publicly perform, sell, license, or otherwise exploit the App or its elements without express authorization; as well as reverse engineering, decompilation, or disassembly.

4.4. No transfer of rights.
Use of the App does not imply the transfer or assignment of Intellectual or Industrial Property rights nor authorization to create derivative developments.

4.5. User content and violations.

• The User shall not publish content (including images/videos) over which they do not hold sufficient rights; nor use the App for unauthorized commercial messages, to harm third-party reputation, or for purposes unrelated to the App.
• If a User publishes content without rights or contrary to these rules, TripOnTrib is exempt from liability toward third parties and may remove content and take action against the infringing User as appropriate.

5. THIRD-PARTY SERVICES AND LINKS

5.1. External links.
The App may include links to third-party sites, applications, or services not owned by TripOnTrib. TripOnTrib assumes no responsibility for their content or practices; access and use of such external sites is at the User’s risk. These Terms do not govern the use of third-party services; the User must review the applicable terms and policies of the third party.

5.2. Third-party features available via the App.
TripOnTrib does not control information, content, products, or services provided by third parties, even if accessible through the App (e.g., payment gateways, maps, messaging, authentication). Consequently, TripOnTrib is not responsible for issues arising from their use. The User agrees to indemnify TripOnTrib against claims arising from the use of such third-party services.

5.3. Third-party advertising.
Any advertising displayed in the App, and links contained therein, shall be governed as above; access and use of the linked content is the User’s responsibility.

6. MODIFICATION OF TERMS

TripOnTrib may modify these Terms and Conditions at any time, notifying Users appropriately. Users are recommended to always consult the latest version available in the Application.

7. AVAILABILITY

TripOnTrib will make efforts to ensure the App’s availability but does not guarantee uninterrupted operation, especially during maintenance or updates.

8. LIABILITY

8.1. User responsibility.
The User shall use the App in accordance with the law and these Terms, being responsible for damages caused by their breach.

8.2. Recommendation regarding private information.
TripOnTrib recommends not publishing private information (e.g., personal contact data, passwords, or any information that could be misused) and to carefully consider how much information to share in the App.

8.3. Exclusions.
To the extent permitted by law, TripOnTrib shall not be liable, including but not limited to: interruptions due to maintenance or external causes; cyberattacks; third-party rights infringements by Users; content posted by Users/Hosts; or the use of information published by other Users.

9. DATA PROTECTION

TripOnTrib will process Users’ personal data in accordance with Spanish and European data protection laws. The User may consult more information in the Privacy Policy and Cookie Policy.

10. APPLICABLE LAW AND JURISDICTION

These Terms and Conditions are governed by Spanish law. Any dispute will be submitted to the courts of Madrid (Spain), unless consumer law mandates a different jurisdiction.
