TripOnTrib Terms of Use

These Terms govern the access, registration, browsing and use of the TripOnTrib digital platform (website, app and associated services). By accessing or using TripOnTrib, the user declares having read and understood these Terms and agrees to be bound by them, together with the complementary documents: Legal Notice, Privacy and Security Policy and Cookie Policy.

These channels are provided to ensure clear and accessible communications in the digital environment, especially in matters relating to security incidents, moderation or data protection.

2 Access Requirements, Registration and User Account

Access to certain features may be available without registration, but the use of advanced social features (creating groups, participating in chats, publishing content, organising trips or interacting with community tools) will require creating an account. The user undertakes to:
  1. Provide accurate and up-to-date information.
  2. Not create accounts impersonating third parties.
  3. Keep their credentials secure and not share them.
  4. Immediately report any unauthorised use or security incident.
TripOnTrib may implement additional verification or authentication measures to strengthen security and prevent abuse, including temporary access restrictions when there are reasonable indicators of risk.

3 Nature of the Service and Limitations of Liability

TripOnTrib is a social digital intermediation platform that facilitates spaces for interaction between users (profiles, groups, forums, chats and planning tools). TripOnTrib:
  • Does not organise trips as a travel agency.
  • Does not act as a contractual intermediary between users unless expressly stated in a specific module.
  • Does not guarantee the identity, conduct, intentions, solvency or accuracy of information provided by users.
Any decision based on community interactions (joining a group, participating in a trip, sharing personal data or making payments to third parties) is made under the user’s sole responsibility, and users should exercise extreme caution and make use of the security and reporting tools available on the platform.

3.1 Access to commercial benefits with third parties

Access to advantageous commercial terms, promotions, discounts or benefits («Benefits») provided by companies in the tourism sector is optional for the user and may be subject to availability, limited duration, quotas or eligibility conditions. Unless expressly stated in the contracting flow, the provision of the tourism service, billing, execution, handling of incidents, cancellations and refunds will be the exclusive responsibility of the third-party provider, with the contract being formalised directly between the user and that third party.

4 Rules of Conduct, Permitted Use and Prohibitions

The user undertakes to use TripOnTrib diligently, lawfully and respectfully. The following are expressly prohibited:
  • Publishing unlawful content or content that violates rights to honour, privacy, personal image, data protection or intellectual property.
  • Disclosing personal data of third parties without a legitimate basis (including doxxing).
  • Engaging in harassment, threats, discrimination, incitement to hatred or any form of violence or intimidation.
  • Impersonating identities or creating fake profiles.
  • Promoting scams, fraud, deceptive recruitment or social engineering practices.
  • Introducing malware, carrying out unauthorised access, exploiting vulnerabilities or attacking the infrastructure.
  • Abusively automating access (scraping), overloading systems or manipulating metrics.
  • Sending spam or unsolicited communications for commercial or recruitment purposes.
TripOnTrib may adopt activity logging, detection and blocking measures to monitor and investigate improper activities using only the strictly necessary information.

5 Prohibition on Commercialisation of Trips in Chats

It is expressly prohibited to use chats (1:1 or group), direct messages or any internal messaging channel to:
  • Offer, sell, resell or act as intermediary for trips, tourist packages, places, tickets, accommodation, activities or tourism services for commercial purposes.
  • Carry out advertising or commercial prospecting of own or third-party tourism services.
  • Request advance payments, deposits or transfers linked to commercial travel offers.
  • Redirect users to external channels (WhatsApp, Telegram, email, social media, websites) with the primary purpose of closing a commercial transaction or acquiring customers.
The above does not prevent the non-commercial sharing of general information about destinations, recommendations, personal experiences or informational links, nor the organisation of trips between private individuals under their own responsibility without any intermediation activity.
TripOnTrib may apply moderation, message removal, feature restrictions, removal from groups, suspension or account cancellation upon reasonable indications of non-compliance.

5.1 Professional Travel Users

TripOnTrib may enable a specific account type for Professional Users in the travel sector (agencies, operators, guides, accommodation providers, carriers…), who, on an exceptional basis and under strict conditions, will be permitted to offer and commercialise services exclusively through expressly designated spaces (verified professional profiles, provider listings, catalogues, booking modules, identified «Pro» channels). Activation of a professional account will be subject to:
  1. A registration and verification process including provider identification, proof of activity and tax/registration details.
  2. Acceptance of the Professional User Terms and Conditions.
  3. A commitment to comply with all applicable regulations (pre-contractual information, contracting, invoicing, consumer protection, advertising…).
The Professional User will be solely responsible for the accuracy of their offer, prices, availability, execution, cancellations, refunds and handling of complaints. TripOnTrib may suspend or revoke Professional User status without prior notice upon reasonable indications of non-compliance, abuse or fraud.

6 User Content: Ownership, Licence and Warranties

The user retains ownership of the rights they hold over the content they publish (texts, images, videos, files). By uploading or publishing content on TripOnTrib, the user grants TripOnTrib a non-exclusive, worldwide licence for the duration of the content’s presence on the platform, to:
  • Host, reproduce, distribute and technically communicate such content in order to provide the service.
  • Allow its display in accordance with the user’s privacy settings.
  • Make technical backup copies.
  • Implement moderation measures (review, concealment, removal or blocking) where appropriate.
The user declares and warrants that they hold the necessary rights and authorisations to publish the content, and that such content does not infringe third-party rights or applicable regulations.

7 Operation of Profiles, Groups and Chats

  • Profile: will contain minimum account information and any optional information the user chooses to publish, with configurable visibility controls.
  • Groups: may be public, private or hidden by invitation; published content will be accessible to the user perimeter defined by the group type.
  • Chats: messages will be visible to the recipients of the 1:1 chat or to the members of the group chat. TripOnTrib may access content only when necessary and proportionate for the management of reports, security or compliance, with restricted access.
The user acknowledges that, once content has been shared with other users, those users may copy or forward it outside the platform, and undertakes not to share sensitive information unless strictly necessary.

8 Moderation, Reporting and Prevention of Unlawful Uses

TripOnTrib maintains a moderation system designed to protect the community and prevent fraud. This system may be based on:
  1. User reports.
  2. Human review.
  3. Automated or semi-automated detection tools (spam, abuse patterns).
When there are reasonable indications of a violation, TripOnTrib may remove content, restrict features, remove users from groups, suspend or cancel accounts, and retain strictly necessary evidence to investigate incidents or respond to requests.

9 Enhanced Protection of Especially Vulnerable Users

TripOnTrib incorporates enhanced mechanisms to minimise risks in social interaction environments, including:
  • Blocking and muting users.
  • Restriction of invitations and messages.
  • Default privacy options.
  • Prioritisation of reports affecting physical safety, harassment, exploitation or scams.
TripOnTrib may introduce additional restrictions when elevated risks are detected (contact limitations for new accounts, enhanced verification or temporary messaging restrictions), seeking to balance security with the community functioning of the service.

10 Account Suspension and Termination

TripOnTrib may suspend or cancel an account, in whole or in part, and/or restrict access to features, without prior notice, when:
  • The user breaches these Terms or the Community Rules.
  • There are reasonable indications of fraud, impersonation, harassment, threats or unlawful conduct.
  • Unauthorised access or security risks are detected.
  • It is necessary to comply with a legal obligation or respond to a valid request.
The user may request the voluntary closure of their account by email. TripOnTrib will apply the retention and erasure/blocking rules set out in its Privacy Policy.

11 Commercial Communications and Consent

TripOnTrib may send communications strictly necessary for the provision of the service (security notices, confirmations, relevant changes). For commercial or prospecting communications (newsletters, promotions), TripOnTrib will require clear consent where required and will provide simple mechanisms for unsubscribing, withdrawal or objection.

12 Liability for Services of Collaborating Third Parties

TripOnTrib may make available to the user features, links, integrations or access to services provided by collaborating third parties (accommodation, transport, activities, insurance, guides, payment methods…). Unless expressly stated otherwise, such third parties act in their own name and under their sole responsibility. TripOnTrib accepts no liability for:
  • The availability, quality, safety, legality or execution of third-party services.
  • Changes, delays, cancellations, overbooking, contractual breaches or damages arising from the provision of the service by the third party.
  • Disputes over prices, charges, penalties or refunds.
  • Claims arising from information provided by the third party or published by users about external services.
Any complaint, withdrawal request, termination or refund must be directed to the service provider in accordance with their applicable policy.
Notwithstanding the above, TripOnTrib may, on a voluntary basis, guide the user towards the appropriate complaints channel, relay incidents to the third party or adopt moderation measures within the platform, without assuming liability for the third party’s provision of services.

13 Data Protection, ARSOPOL Rights and Cookies

The processing of personal data on TripOnTrib is governed by the GDPR and the LOPDGDD. The user may exercise the rights of access, rectification, erasure (right to be forgotten), objection, portability and restriction, and may lodge a complaint with the supervisory authority, in the terms set out in the Privacy Policy. TripOnTrib will use cookies and similar technologies in accordance with its Cookie Policy, providing detailed information, genuine configuration mechanisms and obtaining consent where required.

14 Data Processors and Providers with Access to Data

When TripOnTrib engages providers that need to process personal data in order to deliver their services (hosting, support, analytics, messaging, assisted moderation…), such providers will act as data processors. Their engagement will be governed by a contract that will include:
  • Processing in accordance with documented instructions.
  • Confidentiality obligations.
  • Technical and organisational security measures.
  • Sub-processing conditions.
  • Assistance in the exercise of rights and security obligations.
  • Return or deletion of data upon termination of the service.

15 Security, Breaches and Notifications

TripOnTrib maintains an internal incident and security breach management protocol, with detection, containment and mitigation measures. Where applicable, TripOnTrib will notify the security breach to the supervisory authority and, when there is a high risk to the rights and freedoms of users, will communicate it to those affected without undue delay, in accordance with its Privacy and Security Policy.

16 Updates to the Terms

TripOnTrib may amend these Terms to adapt them to functional, security, moderation or compliance changes. The date of last update will be indicated. If the amendments materially affect the rights or obligations of the user, TripOnTrib may implement additional information mechanisms within the platform. Continued use of TripOnTrib after the new version comes into force will constitute acceptance thereof.
